Densaris Pty Ltd (ABN 16 649 792 870) operates Densaris.com (“the Website”). This website is licensed to sell alcohol under Queensland liquor licensing laws administered by the Office of Liquor and Gaming Regulation (OLGR).

Licence type: Commercial Other — Artisan Producer Licence. Licence details are available upon valid request.

1. Introduction and Acceptance

By accessing, browsing, or purchasing from this website, you agree to be bound by these Terms and Conditions in their entirety. If you do not agree with any part of these Terms, you must not use this website or make any purchase.

We reserve the right to update these Terms at any time. Your continued use of the website after changes constitutes acceptance of the new Terms. We will provide reasonable notice of any material change by email or prominent notice on the website.

2. Legal Age and Responsible Service of Alcohol

You must be at least 18 years of age to purchase alcohol from this website. By placing an order, you warrant that you and any recipient of the order are 18 years of age or older, and that your purchase complies with all applicable laws in your location.

Age Verification: At checkout you must confirm you are 18+. We reserve the right to request additional verification before dispatch. Delivery will be refused if the recipient cannot provide acceptable proof of age (driver's licence, passport, proof of age card, or Australia Post Digital iD app). Australia Post delivery drivers will conduct ID25 checks. If delivery is refused due to age verification failure, no refund will be provided, though we may offer re-delivery to a verified adult at the same address (additional fees may apply).

We support the responsible service of alcohol and may refuse or cancel any order if we reasonably believe it may breach Queensland liquor laws or applicable regulations.

3. Jurisdiction and Governing Law

These Terms are governed by the laws of Queensland, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of Queensland, Australia. Nothing in these Terms excludes rights that cannot be excluded under Australian Consumer Law.

4. Website Use and Acceptable Conduct

You agree to use this website only for lawful purposes, in a manner that does not infringe the rights of any third party, engage in fraudulent or harmful conduct, or breach any applicable laws. We may suspend or terminate your access at any time without notice if we reasonably believe you have breached these Terms.

5. Product Information and Pricing

We take reasonable care to ensure product descriptions, ABV, and pricing are accurate, but do not warrant that all information is entirely complete or up to date. All prices are in Australian dollars (AUD) and include GST where applicable. Prices exclude shipping unless otherwise stated and are subject to change without notice.

6. Orders and Order Acceptance

When you place an order, you are making an offer to purchase. No contract is formed until we have received cleared payment in full and issued an order confirmation email. We may refuse any order for reasons including product availability, age verification failure, suspected fraud, or concerns about the legality of delivery to your location.

7. Payment

Payment is processed by Stripe and must be made in full at the time of ordering. Payment information is not stored on our servers and is handled in accordance with PCI security standards. By making a payment, you also agree to Stripe's terms of service (stripe.com/legal).

8. Shipping and Delivery

We currently ship within Australia only. All orders are shipped via Australia Post's Wine Delivery Service on an insured basis. Signature on delivery is required; a person aged 18 years or older must be available to sign. Australia Post ID25 checks apply. Parcels will not be left unattended without specific authority to leave.

Additional requirements apply in South Australia (signed declaration) and for gift deliveries in Victoria (named addressee only). You are responsible for providing a correct and complete delivery address.

9. Failed or Refused Delivery

If delivery cannot be completed due to absence of an eligible adult, refusal, failed ID verification, or other factors, Australia Post may return the parcel to a collection point or return it to us. You have 10 business days from notification to collect. Redelivery or return-to-sender fees may be passed on to you.

10. Breakage, Loss, and Insurance

All shipments are insured via Australia Post's Wine Delivery Service. You must inspect your order within 2 business days of delivery and notify us immediately of any damage, missing items, or incorrect items. Provide photographic evidence and your order confirmation when reporting. Failure to report within 2 business days may affect our ability to lodge a claim on your behalf.

11. Returns and Refunds

We do not offer refunds, returns, or exchanges for change of mind. If a product is faulty, contaminated, or not as described, please contact us within 14 days of delivery with your order number, photographs, and a description of the fault. Verified faults will be resolved by replacement, credit, or refund at our discretion. Approved refunds are processed within 7–14 business days.

These Terms do not exclude or limit your rights under Australian Consumer Law.

12. Interstate and Remote Area Delivery

We deliver within Australia only. Delivery to remote Indigenous communities, declared dry zones, or locations where delivery would breach local laws may be refused. It is your responsibility to ensure delivery to your location is lawful. If we cannot deliver due to legal restrictions, a full refund will be offered.

13. Delivery Timeframes

Delivery timeframes are estimates only and are not guaranteed. Factors including Australia Post delays, weather, incorrect addresses, and age verification may affect delivery. We are not liable for delays. Please contact us if your order is significantly delayed.

14. Intellectual Property

All content on this website — including trademarks, logos, images, text, code, and design elements — is owned by or licensed to Densaris Pty Ltd and protected by Australian and international intellectual property laws. You may not reproduce, distribute, modify, or use any content for commercial purposes without our prior written consent.

15. Privacy and Data Security

We collect and use personal information in accordance with Australian privacy laws and our Privacy Policy. By using this website, you consent to collection and use of your information for order processing, fraud prevention, legal compliance, age verification, and direct marketing (if opted in). Your name, address, and purchase history are hosted on servers located in Australia. Payment details are handled by Stripe and not stored on our servers.

16. Limitation of Liability

To the extent permitted by law, we exclude all warranties not expressly set out in these Terms. We are not liable for indirect, incidental, or consequential loss. Our total liability for any claim is limited to the amount you paid for the relevant products. We are not responsible for the acts or omissions of Australia Post, Stripe, or other third-party service providers.

17. User Accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any suspected unauthorised access. We may suspend or terminate accounts used fraudulently or in breach of these Terms.

18. Third-Party Links

This website may contain links to third-party sites. We do not control, endorse, or accept responsibility for their content or practices. Your use of third-party sites is at your own risk.

19. Prohibited Conduct

You must not use this website for any unlawful purpose, including fraud, money laundering, breach of liquor licensing laws, interference with the website's operation, unauthorised access, or the purchase of alcohol for supply to persons under 18 years of age.

20. Promotions, Discount Codes, and Gift Cards

Promotional offers are subject to separate terms and availability. Discount codes are for single use only unless otherwise stated, cannot be combined with other promotions, and are non-transferable. Gift cards, where offered, are non-refundable and cannot be exchanged for cash.

21. Complaints and Dispute Resolution

We will acknowledge complaints within 2 business days and provide a response and proposed resolution within 14 business days. Unresolved disputes may be escalated through Australian consumer protection bodies or the courts of Queensland.

22. Indemnity

You agree to indemnify Densaris Pty Ltd and its officers, employees, and agents from any claims, losses, or expenses arising from your breach of these Terms, violation of applicable law, misuse of our website or products, or provision of false information.

23. Force Majeure

We are not liable for failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, pandemics, acts of war, Australia Post operational disruptions, or government restrictions. We will notify you promptly and offer to cancel and refund if a delay is extended.

24–27. General Provisions

Severability: Invalid or unenforceable clauses will be severed without affecting remaining provisions. Waiver: No waiver is effective unless made in writing. Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and Densaris Pty Ltd. Amendments: We may amend these Terms at any time by posting an updated version. Continued use constitutes acceptance.
